Alina Habba has resigned as the US Attorney for New Jersey. This comes after a legal ruling that challenged her right to serve.

Official Departure

The nation's top law enforcement official, Pam Bondi, accepted Habba's resignation on the start of the week. She commented that the court's "flawed" ruling made it unworkable for the official to lead the department effectively.

"Let no one confuse following the order as giving up," she wrote. "This battle will now stretch across the nation."

Court Ruling

The departure was triggered by a US appeals court ruled that she had been acting without proper authority as the federal prosecutor. This judgment is expected to impact numerous prosecutions in New Jersey.

The court declared that a interim role that bypassed the advice and consent of the Senate ran afoul of the federal law governing appointments.

Ongoing Legal Battle

Bondi said that she will remain at the DOJ as a top consultant. She will pursue additional appeals of the ruling, in the hope of achieving a overturned decision.

Prior to assuming the role of US Attorney, Trump had announced he was naming her as his White House advisor in a potential future term, describing the lawyer as a steadfast ally and a dedicated fighter for justice.
